Disabled Employment Discrimination

The Americans with Disabilities Act (ADA) was created in part to protect individuals with disabilities from discrimination in the workplace. A person with a disability can face discrimination at all stages of employment: The job application process, hiring, pay, promotions, job training and discharge.

Most individuals who have been discriminated against because of their disability do not even know it. Some signs of discrimination include comments about or harassment due to a person’s disability, being refused promotions, and being subjected to different work conditions and different privileges than co-workers. If a person is able to perform the essential functions of a job with (or without) the help of minor accommodations, any of these forms of discrimination are against the law.

The protections of the ADA apply to people who do not have disabilities, but who are wrongfully perceived as having a disability.  In addition, an employer may not fire, harass or otherwise retaliate against an employee for seeking a reasonable accommodation or making a complaint about disability discrimination.
